Behörighetskrav

Juristexamen eller kandidatexamen i juridik med inriktning folkrätt eller motsvarande samt Engelska B alternativt Engelska 6.

Kursens huvudsakliga innehåll och upplägg

Kursens övergripande syfte är att fördjupa studentens förståelse för hur folkrätt inverkar på planeringen och genomförandet av militära, i synnerhet multinationella, fredsoperationer.

Kursen berör inledningsvis de folkrättsliga grunderna för fredsoperationer, framför allt mandat från FN:s säkerhetsråd och inbjudan av värdstaten. Därefter behandlas den folkrättsliga och politiska regleringen av vålds- och tvångsanvändning och andra åtgärder inom ramen för fredsoperationer. Avslutningsvis berörs ansvarsfrågor särskilt kopplade till fredsoperationer.

Kursen inleds med föreläsningar varvat med självstudier. Därefter varvas föreläsningar och seminarier, vilka tillsammans ger studenterna underlag till den avslutande skriftliga hemtentamen, som skrivs individuellt.

Efter att ha genomgått kursen förväntas studenten kunna:

Kunskap och förståelse
  • identifiera och förklara de folkrättsliga grunderna för olika typer av fredsoperationer.

Färdighet och förmåga
  • identifiera och analysera de särskilda frågor avseende statsansvar, ansvar för internationella organisationer och individuellt straffrättsligt ansvar som aktualiseras i fredsoperationer,
  • tillämpa den folkrättsliga regleringen av vålds- och tvångsanvändning samt andra åtgärder inom ramen för olika typer av fredsoperationer.

Värderingsförmåga och förhållningssätt
  • kritiskt värdera de folkrättsliga grunderna för olika typer av fredsoperationer, inklusive kraven på att kvinnor och män på lika villkor ska delta aktivt i fredsprocesser relaterade till fredsoperationer samt erhålla effektivt skydd mot genusbaserat våld i sådana situationer.

Examinationsformer

Skriftlig hemtentamen
Omfattning: 3.5 Högskolepoäng

Betygsskala: Underkänd, Godkänd, Väl godkänd

Examination sker genom skriftlig hemtentamen.

Deltagande i obligatoriska seminarier
Omfattning: 1.5 Högskolepoäng

Betygsskala: Underkänd, Godkänd

Examination sker genom obligatoriska seminarier.

Sent inkomna examinationer betygssätts inte om inte särskilda och av examinator godkända skäl föreligger.

Examinator kan besluta om komplettering för att betyget godkänd på kursen ska kunna uppnås. Komplettering ska inlämnas senast tre arbetsdagar efter att besked om komplettering meddelats, om inte särskilda och av examinator godkända skäl föreligger.

Betyg
Betygssättning sker genom en tregradig betygsskala, Väl godkänd (VG), Godkänd (G) och Underkänd (U). Betygskriterier redovisas senast vid kursstart.

För betyget Godkänd (G) krävs aktivt deltagande vid obligatoriska seminarier och Godkänd (G) på skriftlig hemtentamen.

För betyget Väl godkänd (VG) på kursen krävs utöver krav för Godkänd (G) Väl godkänd (VG) på skriftlig hemtentamen.

Antal examinationstillfällen
Antalet examinationstillfällen är inte begränsat.

Övergångsbestämmelser

När kursen inte längre ges eller när kursinnehållet väsentligen ändrats har studenten rätt att en gång per termin under en treterminsperiod examineras enligt denna kursplan.

Övriga föreskrifter

Kursen kan inte ingå i examen med annan kurs vars innehåll helt eller delvis överensstämmer med innehållet i denna kurs.

Kursen ges inom Försvarshögskolans magisterprogram i Internationell operativ juridik och kan även ges som fristående kurs.

Om en student har ett beslut från Försvarshögskolan om särskilt pedagogiskt stöd pga. funktionsnedsättning, får examinator besluta om alternativa examinationsformer för studenten.

Kursvärdering genomförs efter avslutad kurs genom kursansvarigs försorg och ligger till grund för eventuella förändringar av kursen.
